The new lawyer for Thelma Fardin (28) announced this Wednesday that

the Brazilian Justice will investigate

Juan Darthés (56) for the complaint of sexual abuse he made in 2019. 

The actress and her legal representative spoke about the news of the cause in a press conference called together with Argentine Actresses and Amnesty International with the slogans "Look how we get on" and "Sounds all over the world."

There he also told that he has a

new legal advice

, in charge of the lawyer Martín Arias Duval.

The actress thanked Sabrina Cartabia, who had led the cause.

Arias Duval explained that Brazil's public prosecutor's office

initiated an ex officio investigation

and a request for the evidence collected by UFEM at the request of Nicaragua to be made available to the Brazilian justice system.

"The public prosecutor's office of Brazil said that there is sufficient merit for a case against Darthés to be opened," he said.

Beyond this request, the extradition request made by Nicaragua persists

The announcement represents a breakthrough in the cause.

Darthés - whose real name is Rafael Pacífico Dabul - has dual citizenship and is living in Brazil, where he was born, since shortly after the complaint was known.

Brazil

does not have an extradition treaty

with Nicaragua (the country where the abuse would have occurred and where the criminal complaint is based);

and, although the defendant said at first that he would travel to testify, he never did.

The Nicaraguan justice had even ordered his international arrest and detention for "aggravated rape."

Interpol, for its part, had issued a red card in 2019.

The complaint

On December 11, 2018, the Actrices Argentinas collective summoned the media for an announcement amount.

The objective was to accompany and make visible the criminal complaint made by Thelma Fardin against Juan Darthés, for a case of sexual abuse that would have occurred in 2009, when the actress was 16 years old and was on tour with the play "Patito Feo", in Nicaragua.

The video broadcast that day, where the young woman recounted the events, culminated with the slogan "Look how we wear" and generated an immediate impact.

Not only did it arouse solidarity, but complaints of abuse soared, as well as calls to line 144 and the Casa del Encuentro, by women who decided not to keep quiet.

Among those who accompanied Thelma was Calu Rivero, who had previously made public situations of constant harassment by the actor, which would have even cost him his job in the novel "Sweet Love."

Based on Rivero's testimony, the actresses Natalia Juncos and Anita Coacci had also related similar experiences, which occurred years ago, that they would have kept hidden out of fear.

With Thelma's complaint - who thanked her colleagues for encouraging her to speak - the social condemnation weighed on the actor, who sought to disappear from the public eye, after a few interviews.

His first lawyer, Ana Rosenfeld, claimed to feel "disappointed" in the face of a "lack of trust" towards her client and abandoned her representation.

The defense began to be in charge of Fernando Burlando.

As it transpired, Darthés would be rebuilding his life in San Pablo with his family.

Although he tried to remain anonymous and away from the cameras, two years ago, the program "Fantástico: O show da vida", from the Red Globo signal (which has a weekly audience of 50 million viewers), dedicated a report to him .

There appeared Thelma, her then lawyer Sabrina Cartabia, journalists Jorge Rial, Ariel Wolman and Valeria Sampedro.

Currently, the actor is taking the first steps with his own theater production company.

Neither he nor his lawyer have given any statements about the news of the case.
