Weimar: Mask requirement lifted

In the proceedings against a district judge who overturned the corona rules at two Weimar schools in a questionable decision, new details became known.

The public prosecutor's office in Erfurt confirmed to SPIEGEL that the man's living and work rooms had been searched.

A cell phone was confiscated.

Several media had previously reported on it.

Proceedings are pending against the judge on suspicion of perversion of the law.

At the beginning of April, the family judge overturned the mask requirement at two schools in the city by means of an interim order.

He referred to the best interests of the child.

In addition to the justification, lawyers had also questioned the jurisdiction of the judge.

The case of the two students allegedly impaired by the masks was also apparently deliberately leaked to the judge.

Removal of the mask requirement collected again

The Weimar Administrative Court had declared the mask requirement in teaching at Thuringian schools to be legal last week.

The judges pointed out that they regard the Weimar decision as "obviously illegal".

Family courts are not empowered to issue orders to authorities.

There is no legal basis for this.

The public prosecutor's office also sees indications that the accused "arbitrarily assumed his jurisdiction" even though it was an administrative matter.

There is an initial suspicion that he "consciously and seriously distanced himself from law and order" in making this decision.

An initial suspicion is given if, based on concrete facts, based on criminal experience, it appears possible that a criminal offense has been prosecuted.

The public prosecutor's office had already announced the investigation of the incident after several criminal charges had been received against the judge.
