Austrian citizen purchased a two-story penthouse apartment in Tel Aviv about 13 years ago. She purchased the building rights to the roof part of the condominium above her apartment.

She installed a deck floor, a Jacuzzi, sunbathing facilities and even a private exit, which will belong only to her. Her neighbors filed a lawsuit with the Land Inspectorate, demanding that she vacate the roof for the benefit of all the tenants. The court accepted the arguments of her neighbors - and ruled that she could not take over the shared roof.
