The Advocates General requested a "confiscation of the profit" made by Servier from the drug. This request, unprecedented in terms of deception, leads to much heavier requisitions than the fine of 2.7 million euros pronounced at first instance against the pharmaceutical laboratory.

Jean-Michel Seta, former CEO of Servier, is the only natural person accused in this appeal trial. At first instance, in March 2021, he was sentenced to four years in prison suspended and a fine of 90,600 euros.
