Photographer Lynn Goldsmith sued Andy Warhol for using his image. Warhol created a series of silkscreens from an image taken by Goldsmith of the singer Prince.

Seven justices agreed with that view; the other two showed their opposition. The decision can change the rules of the game of artistic creation, as well as the legal consequences of starting from a previous work, such as in the case of Warhol's serigraphs. The ruling was handed down by a federal judge in 2001.
