The Constitutional Court avoids assessing whether the Electoral Board should have recognized Junqueras as a MEP. The court argues that the European Parliament has already done so and does not clarify whether it is an essential requirement to collect the minutes in person and swear or promise the Constitution to access office.

The matter may be relevant on the eve of new European elections in the event that the problem is reconsidered with an elected candidate - as could happen with the former Catalan president Carles Puigdemont - who next June would continue to be the subject of an internal arrest order.
