The ECHR rejects the request of a French mother contesting the handing over of her child to her Japanese father. The applicant had gone to live with her husband in Japan.
But in July 2017, returning to France with her son to spend the summer holidays, she finally decided not to fly again and to file for divorce. The courts "did not order the child's return automatically or mechanically" but "duly took into account (his mother's) allegations during an adversarial and fair procedure"
