In the case of alleged gang rape in Freiburg, the prosecution has dropped the rape charge against one of the eleven defendants. His defense requested that he be released from custody after eleven months.
The charge of rape against the man from Syria can not be maintained, said prosecutor Rainer Schmid before the district court. There is no evidence that the 25-year-old had no DNA traces found.
Against the man remains the charge of failure to help. This justifies no pre-trial detention. Whether the arrest warrant is canceled, the court must now decide.
The rape allegations against the ten other defendants remain according to prosecutors. Accused in the process started in late June are eleven men from 18 to 30 years - most of them are refugees. They have been in custody since their arrests.
