The Federal Prosecutor's Office and the defense have demanded acquittal for two prison officers before the Federal Court of Justice (BGH), which had sentenced the Landgericht Limburg to 9 months' probation for its negligent homicide.
The woman and the man had granted a prisoner in Rhineland-Palatinate open execution. The inmate, who had already served several times for driving without a driver's license, had raced into the carriage of a young woman during a clearance as a ghost driver on a highway near Hessian Limburg. He was on the run from the police with a stolen license plate.
The 21-year-old female driver died in the collision in January 2015. The man was later sentenced to life imprisonment for murder. (2 StR 557/18).
Both the defense lawyers and the representative of the Federal Prosecutor's Office criticized in the trial in Karlsruhe legal errors in the judgment of the Landgericht Limburg. The two officials made decisions within their discretionary powers. They are not responsible for the prisoner's act. The verdict is to be announced on November 26th.
