Investigation Error: Suspect could continue to abuse children despite self

According to North Rhine-Westphalia Minister of Justice Biesenbach, there were serious investigative errors surrounding the misuse of Bergisch Gladbach. Meanwhile, a ninth suspect was arrested.

Investigators made mistakes regarding the child abuse case of Bergisch Gladbach: failures of the judiciary led to a pedophile father having the opportunity for months to abuse and offer abuse to children.

In a question time of the North Rhine-Westphalian Landtag on the status of the investigation into sexual abuse of children, Minister of Justice Peter Biesenbach (CDU) admitted on Wednesday "two technical errors" of the prosecutor Kleve. He regrets this, said Biesenbach. The failings have the Attorney General Dusseldorf now found in a review "unmistakably".

The background: A 26-year-old Bundeswehr time soldier had already been targeted by the public prosecutor's office last June because he had sexually abused his five-year-old stepson and his three-year-old daughter in the absence of his wife, as Biesenbach reported. The abuse had come after the stepson had confided in his mother. The same evening, the perpetrator had reported, according to the prosecutor Kleve himself, admitted five cases of abuse of both children and "remorseful and therapiebereit" shown.

The children should have been heard

The youth welfare office had then imposed a ban on contact of the man to the children and the wife had committed to ensure this. Therefore, the prosecutor had expected no further crimes and also saw no danger of flight. As a result, she has also made no application for a pre-trial detention order, reported Biesenbach. The man had not been arrested.

The Attorney General in Dusseldorf has now objected to the action in a recent review. Thus, a search warrant and an accelerated witnessing of the children would have been necessary. The latter was not done until today. Also a DNA comparison would have to be done sooner.

In the course of the investigation into child abuse of a large child pornography chat ring, which has flown up in Bergisch Gladbach, but reaches far beyond, the 26-year-old was again targeted by the investigators. With a suspect from Bergisch Gladbach, the Weseler exchanged child pornography recordings "and also talked about a meeting for the purpose of joint sexual abuse of his three-year-old niece", as Biesenbach said. As a result, the 26-year-old was arrested on 25 October, months after his self-disclosure.

Ninth arrest in abuse of Bergisch Gladbach

The dimension of the investigation is getting bigger. On Wednesday, a ninth arrest in Rhineland-Palatinate became known in the case. The man had come into custody, said a spokesman for the NRW Justice Department. He did not name further details. There are currently nine men in custody, according to the spokesman, seven in NRW, one in Hesse and one in Rhineland-Palatinate. Previously, the WDR had reported on the ninth arrest.

Reul spoke of a "huge pedophile child porn network with chat groups up to 1800 participants". Unlike the years of child abuse on a campsite in Lügde, the investigation around Bergisch Gladbach "many perpetrators from all corners of Germany" have been revealed.
