Richter considers NPD slogan partly for reality

The reasoning of the community: not convincing

The reason for the verdict was a lawsuit by the extreme right-wing NPD against the Hessian municipality of Ranstadt. The community had just before the European elections in May 2019, all NPD posters with the words "Stop the invasion: migration kills resistance now" hang.

The poster fears fear of foreigners and gives the impression that all migrants living in Germany are potential murderers, so the community justified their action at that time. The judge found that less convincing.

Instead, the judge stated that the posters did not fulfill the incitement to sedition, since the immigration of refugees was indeed an "invasion".

Judgment not yet final

The verdict is not yet legally binding. The judge admitted because of fundamental importance the appeal to the Hessian administrative court. According to "Legal Tribune Online", the defendant city has already filed an appeal. A decision will only be made in the coming year.

In a similar case, the administrative court of Dresden had awarded the city of Zittau right. The city had also NPD posters with the words "migration kills" depend - these correspond according to the judgment of May 2019 the offense of incitement.
