(ANSA) - MILAN, JANUARY 17 - A "feeling of general antipathy, impatience or refusal" for reasons "related to race, nationality", is not enough to configure the crime of propaganda of ideas based on racial hatred, but there must be "a conduct discriminatory which is based precisely on the 'personal quality' of the subject, and not, instead, on his behavior ".
This can be read in the grounds of the sentence with which the Cassation canceled, with postponement to a new appeal judgment, the 6-month sentence for two traders who in 2013, after the 'Kabobo case' in Milan, put a poster on their advertising truck written "clandestine kills three Italians with pickaxes - death penalty immediately".
On the poster there is also the "reproduction of a guillotine with the blade dripping blood and next to it the image of the head of a beheaded black man". The Supreme Court upheld the appeal of the lawyer Carlo Sergio Oldani, lawyer of Mirko Rosa, a former well-known owner of 'buy gold' shops and of his father.
