When sick employees feel better again, many want to work again despite being on sick leave. But is that even allowed? Or is there no insurance cover?
When the work piles up on the desk, many sick leave employees are plagued by a guilty conscience. Most of the time, the colleagues have to serve as representatives. Many then wonder whether they can return to work earlier despite sick leave. Do you need a health record from your doctor? And is there insurance coverage at all? Can I work despite being on sick leave?
Even if some would not suspect: If you want to work despite your sick leave, you can also return to your workplace. This is confirmed by lawyer Volker Werxhausen at Wirtschaftswoche.
"In a certificate of incapacity for work, the doctor only gives a forecast of how long his patient will be unable to work. The forecast does not necessarily have to be correct for the entire duration of the certificate. An employee can therefore go back to work before the sick leave expires, " explains Werxhausen and adds "He even has to if he is able to work early again."
Staying at home, even though you are actually fit again, actually violates this rule. However, this also depends on the illness and the job. An employee who works in the office can do more with a broken arm than a bricklayer on the construction site, for example.

Boss can send sick employees home
The situation is different when an obviously sick employee wants to work. The boss can and should even send sick employees back home because the employer has a duty of care towards his employees. "If the boss thinks that the employee could endanger himself or others, he even has to prohibit him from working," says the labor law expert.

Is there insurance coverage if I go on sick leave?
There are also numerous myths surrounding insurance coverage. Here you can breathe a sigh of relief: for health insurance and statutory accident insurance , it doesn't matter whether you go back to work earlier. So the way to work is definitely insured.
