(ANSA) - NEW YORK, JUL 29 - Ashley Judd wins on appeal against Harvey Weinstein and will be able to sue the former producer for sexual harassment, already sentenced in New York for harassment and rape. The go-ahead for the actress came from a commission of three judges from a federal appellate court that rejected the position of a lower court that Judd was not Weinstein's employee at the time of the meeting.
The judges ruled that Weinstein had exercised an undue position of power by inviting the actress to the Sufficient Hotel Peninsula in the mid-nineties nominally to speak for work. "Their relationship was unbalanced and Weinstein could exercise this power by being one of the major Hollywood producers," said Judge Mary Murguia on behalf of the troika. Judd sued Weinstein in 2018 stating that Miramax's exboss lured her to her hotel room to ask her to watch him while she was in the shower and then attempted to massage her. The actress had rejected advances and in the complaint she claims that, as a result of her refusal, Weinstein had managed to put her on the index in Hollywood. (HANDLE).
