The Antitrust reiterates: the restrictions by municipalities on the expansion of 5g technology are unjustified. (HANDLE)


(ANSA) - ROME, AUGUST 17 - The Antitrust reiterates: the restrictions of the municipalities on the expansion of 5g technology are unjustified. In fact, the latest bulletin states that "the provisions of the local administrations are legitimate in the measure in which they allow 'an always possible alternative location' (of infrastructures, ed) and do not instead determine 'the impossibility of location'. This principle has also been repeated several times by the State Council ".
    Furthermore, the Antitrust Authority has always stated that the Council of State has already stated: "" the illegality of a municipal regulation adopted pursuant to article 8 paragraph 6l must be declared. 22 February 2001 n. 36, where the local authority has set itself the objective, although not declared, but which can be deduced from the content of the regulatory act, that of preserving human health from electromagnetic emissions emanating from radiocommunication systems (for example through the establishment of minimum distances of radio base stations from particular types of settlements. "
    Therefore - writes the Authority - "Administrative acts, such as trade union ordinances or other policy acts, which prohibit the experimentation, installation and dissemination of 5G mobile telecommunication systems with 5G technology, pending more updated scientific data, constitute an absolute and general obstacle to the installation of mobile telecommunication systems with 5G technology and represent a barrier to the free development of competition, as well as to the freedom of establishment and the provision of services by telephone operators ".
   Therefore "In light of the importance of the effects on the economic entire system that 5G telecommunication technologies will have in the coming years in Italy, the Authority considers the elimination of unjustified and non-proportionate obstacles to the infrastructural intervention by defining an administrative action as a priority effective and efficient ".
