A week after its entry into force, the Strasbourg administrative court on Monday, again challenged a prefectural decree imposing the wearing of masks generalized in the city.

The administrative justice, which had already annulled a first similar decree at the beginning of the month, considers that this new decree carries "a serious and clearly illegal attack" to the "right of everyone to respect for personal freedom".

She therefore "enjoins" the Prefect of Bas-Rhin, Josiane Chevalier, to identify "the Strasbourg districts which are not characterized by high density or high traffic", in order to distinguish them from areas in which "the port of mask would be essential ”.

21 applicants

The current decree, in force since September 7, will have to be amended "no later than September 18 at 12 noon".

Otherwise, the execution of the “contested decree” will be “automatically suspended”.

This new appeal, which concerns only the city of Strasbourg, had been filed by 21 applicants, including psychologist Vincent Feireisen and doctor Christian Chartier.

"We are satisfied with the new administrative court order, it is a balanced position which will allow better adherence" to the rules relating to the wearing of a mask, declared Vincent Feireisen.

"It is a common sense measure, if the physical distance can be respected, everyone is smart enough to know that the mask is not useful," he added.

Specific stops

Vincent Feireisen and Christian Chartier had already challenged before the administrative court a previous prefectural decree which imposed the general wearing of masks in the municipalities of Bas-Rhin with more than 10,000 inhabitants.

The court had imposed on September 2 the modification of the decree, in order to exclude the communes and "the hourly periods" which were not characterized "by a high density of population".

Consequently, the prefect Josiane Chevalier had taken specific and detailed orders for each of the municipalities concerned, except for Strasbourg, where she had again imposed the wearing of the generalized mask.
