"Upskirting" becomes a criminal offense

The Federal Council has approved a law that punishes secret photography under the skirt more severely. So far, those affected have hardly been able to defend themselves by legal means.

Secretly filming or taking photos under the skirt or in the clipping can in future be punished with up to two years in prison.

The same applies to the distribution of such recordings.

A corresponding tightening of the law was finally approved by the Federal Council on Friday.

So-called upskirting, in which photos or films are taken under skirts and dresses, was usually not a criminal offense under the previous legal situation.

In the future there will also be fines if someone photographs or films people who have died in an accident.

So far, criminal law has only protected living accident victims.

The regulations are expected to come into force this year.

The tightening is intended to curb the spread of such recordings, especially via social networks.

Cell phone cameras are now able to take high quality images, according to the draft law.

The increasing availability of cameras and the possibility of using them easily and inconspicuously mean that the rights of the people depicted are not being observed by the recording people.
