Childcare, cleaning ... Home jobs remain authorized during confinement

In a decree, the government specified that these services would remain allowed during the coming weeks, respecting the health protocol.


Many French people can breathe.

Despite the shutdown of part of the economic activity deemed non-essential since the start of the reconfinement, home jobs, and therefore childcare, nannies, life assistants or even households will be well maintained during the coming weeks, as specified in a decree published on Monday, November 2.

In cases where the place of exercise of the professional activity is the client's home, travel (...) is authorized for professional activities of personal services

", indicates the decree.

Among these activities listed in the Labor Code, we find childcare, assistance to the elderly and disabled people, but also "home

maintenance and housework

", "

small gardening jobs

" , "

small DIY

" work, tutoring or even home beauty care, but only for dependent people.

Sanitary protocol

The support of the equipment necessary for the respect of the sanitary protocol by the employees at home differs according to these two scenarios: either the customer calls on a company which will provide him with one of its employees for a home job, or he calls on an individual directly and then becomes a “

private employer

”.

In the first case, according to Capital, it is up to the company which employs the employee to provide the equipment necessary for strict compliance with the usual health protocol (masks, gloves, hydroalcoholic gel, etc.).

In the second case, according to the Federation of Individual Employers (Fepem) of France contacted by

Le Figaro

, it is up to the individual to provide said equipment, listed precisely according to the trades on this page.

There is one notable exception, however.

Indeed, families who call on assistants for the elderly, disabled or chronically ill will be able to provide themselves free of charge in masks in pharmacies, the payment being covered by Health Insurance.

For this, "

the life assistants have since the spring of a document from Urssaf which they present in pharmacies to remove their masks

", specifies Fepem.

No partial unemployment

Note that if an individual does not wish to maintain his usual hours of employment at home during confinement, he will however have to pay them to his employee.

Strictly speaking, partial unemployment does not exist in the home employment sector.

A similar device was put in place in the spring, with 80% of the net salary paid by the State in the event of non-working hours (against 84% for partial unemployment) to compensate for the loss of income.

A request has been made by Fepem to the government to maintain this device, but the federation is still awaiting a response.

In all cases, if the employer contracts covid-19, he must obviously inform the service provider or the employee, otherwise he will be held liable in the event of transmission of the virus.
