Registered mail:
The deliverer throws the letter with the notice of termination in your employer's mailbox, which the postman also confirms in writing.
The fatal thing about it: The employer
does not have to confirm
that he has received the notice.
In the event of a dispute, from a legal point of view
only “prima facie evidence” can be
provided, so access is only assumed.
However, legally secure access cannot be proven.
Registered mail with acknowledgment of receipt:
With this variant, the employer confirms with his signature on the acknowledgment of receipt that he has received the letter of termination.
The return receipt goes back to you, so you have the confirmation of receipt of the termination.
But even this way has its pitfalls: If the postman doesn't find your employer, he brings the letter of termination to the nearest post office and leaves a notification slip.
If the letter is not picked up there, it will be sent back to the sender.
You then have to send the notice of cancellation again
- the notification slip is not sufficient as evidence.
The notice period could then already have expired.
Registered personal delivery:
Only the actual recipient or an authorized person may receive the letter of termination and must sign it.
If this is not found, the letter goes back to the nearest post office, where you can pick it up and have to send it again.
Even if this is the safest way to terminate by registered mail, there is a high risk that the period of notice will expire in the meantime.
Deliver the termination on time: This is the best option
It is therefore safest
to hand over
the letter of termination in
person
and to have receipt acknowledged in writing.
However, it is also
sufficient
to
drop
the letter
in the company mailbox
.
Alternatively, you can instruct a relative or friend to deliver the letter to your employer upon termination.
