This is a case that could well set a precedent ... Last July, Sébastien Klem, an employee of the HLM office in Mulhouse, in the Haut-Rhin, was dismissed for "
serious misconduct
" because he had returned to work after have passed a Covid-19 test which has been positive on oneself.
His employer accuses him of having endangered the lives of his colleagues by coming to work while waiting for his results while hiding any symptoms.
He then had only a "
slight cough
" but no other symptoms, as evidenced by a certificate taken the day after his test by his attending physician.
