On Wednesday, the Council of State annulled two major provisions of the decree of July 2019 on the much maligned reform of unemployment insurance, postponed due to the crisis and which the unions have all demanded since the removal.
In a press release, the Ministry of Labor indicates that it

takes
note of the decision of the Council of State and continues to consult on changes to the regime with the social partners”.

In detail, the verdict of the highest administrative court concerns the methods of calculating the daily reference wage (SJR), which serves as the basis for unemployment benefit.
But also on the bonus-malus system on the unemployment contribution for companies too greedy in short contracts, which should apply normally on April 1, 2021. Two key measures of the reform.

“As part of our dialogue with the social partners, (…) we are currently finalizing a response which seems to me to be balanced between full respect for the philosophy of the reform and taking into account certain specific situations.
We will have made this adaptation before March 31, 2021, the effective date of the Council of State's decision: there will be no interruption of unemployment insurance rights for any beneficiary, ”
commented the Minister. Élisabeth Borne.
For its part, the CGT spoke of
"a first victory".
As for the CFDT, it asks the government
"more than ever to renounce its reform",
which
"carries with it the seeds of new fractures"
.
Due to the crisis and the explosion in unemployment, the government suspended the application of the reform until April 1, 2021. And this, to give itself time to find a more adequate setting.
