Kempten: person in need of care died - burglar is on trial for murder after being fatally handcuffed

A seriously ill man choked and gagged to death after an attack. The trial against one of the originally two alleged perpetrators has started before the regional court in Kempten.

After a fatal assault, a 29-year-old has to answer for collective murder before the Kempten district court.

He is said to have left his victim tied up and gagged after a theft and thus caused his death.

The 50-year-old victim suffered from diabetes, had a heart condition, was almost completely blind and was severely restricted in movement due to a partial amputation of both feet.

For the defendant it was foreseeable that the man would suffocate, the prosecutor said in their indictment.

The victim got to know the alleged murderer through a contact exchange on the Internet and invited him to his home.

Originally another man was supposed to be in the dock for collective murder.

He committed suicide while in custody.

This man had looked after the future victim for more than two years through a neighborhood help.

The remaining defendant reportedly presented himself as a victim in court. He had been forced by an acquaintance to help him with the crime.

Accordingly, his family was threatened.

The main trial will show which of the two was the main culprit.

Gaining trust via a fake online profile

Despite his limitations, he maintained a variety of sexual contacts, according to the prosecutor.

He also asked his friend from the neighborhood help to get in contact via the Internet.

The prosecution accuses the defendant of having concocted the plan together with his friend to establish contact with the man via a fake online profile and then to attack him.

As a neighborhood help, the acquaintance knew, according to the indictment, that the man was keeping cash and valuables in his apartment.

The now accused is said to have overpowered and gagged the victim after arriving on the alleged date.

Although he had to realize that the man would die, he left him helpless, according to the indictment.

The defendant escaped with 3500 euros in cash, jewelry and coins, which he is said to have shared with the alleged accomplice.

A man is also on trial who had kept part of the booty and is therefore now charged with stolen goods.
