In the trial for the murder of the Kassel District President Walter Lübcke, the Frankfurt Higher Regional Court (OLG) had files from a former lawyer of the main defendant Stephan Ernst secured.
These have now been spotted by the responsible Senate, said an OLG spokeswoman.
These are documents from the Dresden attorney Frank Hannig, who was recalled in July as defense lawyer for the alleged Lübcke murderer.
The North German Broadcasting Corporation (NDR) had previously reported on the topic.
On December 1, the offices of Hannig's lawyer were searched, according to the broadcaster's report.
So far, the spokeswoman has not said what findings the court is hoping for.
The further procedure regarding the files will be discussed on Thursday at the hearing.
Hannig plays a special role in the process because he is said to have advised his client Stephan Ernst to make an incorrect confession.
That is why the Kassel public prosecutor's office is investigating the lawyer.
Ernst is accused of having shot the CDU politician Lübcke on his terrace in the Kassel district in June 2019 for a right-wing extremist motive.
Ernst had made various confessions about the act.
For example, he temporarily accused co-defendant Markus H. of having fired the shot.
Ernst has since revoked this and stated that Hannig had urged him to make the wrong statement.
Ernst had separated from Hannig during the ongoing process because of a broken relationship of trust.
