(ANSA) - ROME, DEC 03 - The woman who gave birth to him will not be able to participate in the judgment of legitimacy before the Consulta on the case of the child son of two fathers. The Court declared inadmissible the request of the "gestational mother" to intervene in support of the legitimacy issues raised by the Supreme Court on the rules that prevent the transfer in Italy of a child born abroad with a practice of surrogacy, the name of the father is not biological. The trial is set for next January 27th, with an Italian couple, married in Canada, who had been refused by the Municipality of Verona to recognize the deed of that country in which both are indicated as parents. The Court of Appeal of Venice had accepted their appeal, but the Ministry of the Interior and the Mayor of Verona had challenged the sentence, which thus ended up in the Court of Cassation. Last April the first civil section of the Supreme Court had ordered the transmission of the deeds to the Council, raising doubts about the constitutionality of a set of rules, starting with the law on assisted fertilization.
