Quarantine and continued payment of wages: who pays the salary?
As a rule, quarantined workers
do not have to worry about their salaries
.
Who is responsible for the continued payment of wages, however, depends on various factors - for example, whether you are sick in quarantine:
You are sick with Covid-19:
If you are in quarantine because
you are sick
with Covid-19, you will receive a certificate of incapacity for work (AU) from your doctor.
With this, he reports sick to his employer.
As with any other illness, continued wages are paid through the employer.
They do not show any symptoms of a Covid-19 disease:
According to the National Association of Statutory Health Insurance Physicians, the doctor is not allowed to take sick leave if you have no symptoms such as cough, fever or sore throat in quarantine.
This applies even if you tested positive for SARS-CoV-2.
If you are able to work in the home office, you have to work in quarantine and receive your regular salary.
All others are de facto subject to an employment ban due to the quarantine.
Employees then receive
compensation in accordance with the Infection Protection Act in the amount of their net salary.
For this purpose, the employee submits the official notification of the quarantine order to the employer.
Compensation will be paid during the first six weeks of quarantine.
The employer can in turn get this back from the responsible authorities.
From the seventh week onwards, the employee receives a payment equal to the sickness benefit.
No continued payment of wages on return from risk area
But be careful: Anyone who has to
be quarantined
because of an
avoidable trip to a risk area
will
not receive any compensation
for the loss of wages
under the Infection
Protection Act (Section 56 (1) sentence 3 IfSG).
That is through the Third Civil Protection Act
regulated.
If you cannot work from home in this case, you will receive nothing in terms of continued wages.
Working in quarantine - yes or no?
Even in quarantine, there is a
general duty to work
as long as work
can be done
in the
home office
.
Anyone who pursues a job where this is not possible is usually exempt from their work obligation (read more about this here).
