(ANSA) - PALERMO, 09 JAN - The ship of the NGO Open Arms would have acted on its own initiative, outside the rules on rescue at sea, in an attempt to bring irregular migrants into Italy.
For this reason, Italy would have banned entry into territorial waters right from the start.
It is the defense of the leader of the Lega Matteo Salvini accused of unjustment and refusal of official documents for having denied the landing in Lampedusa to the Spanish ship with 147migrants on board.
The preliminary hearing began today in Palermo.
For the defense, it was not for Italy to indicate a "safe harbor" (POS) to migrants who had boarded the Open Arms ship recovered in Libyan and Maltese waters by a Spanish-flagged ship.
Italy, for the lawyers, was in fact neither a state of first contact nor a coordinating state, having never taken on the coordination of rescue operations.
In addition, minors who arrived near Italian waters had been disembarked.
Another point on which the defense insists is that the Commander of the Open Arms Ship has always had numerous alternatives.
