Car accident: Court awards dog owners 20,000 euros in damages

A car driver and his liability insurance have to pay a dog owner around 20,000 euros because of an accident - including for physiotherapy. That was decided by a court in Munich.


A dog owner was awarded around 20,000 euros for physiotherapy and damages after a car accident.

In particular, the physiotherapy of the animal injured on one paw was necessary because the dog, which was four months old at the time of the accident, was still growing, the district court of Munich I decided in a judgment published on Tuesday.

).

According to the information, an employee of the dog owner led the Rhodesian Ridgeback males for a walk on the leash on the day of the accident on November 15, 2017 on the private property of an industrial park in Munich.

There the animal would later be used as a guard dog.

The person who caused the accident drove over the area at an excessive speed of at least 20 kilometers per hour - twice as fast as allowed - and caught the dog on the left front paw, according to the court.

Liability for future consequences of injury

The judge in charge decided that the dog on a leash had not posed a typical animal hazard and that the owner was not responsible.

Therefore, the motorist and his motor vehicle liability insurance have to pay.

According to the information, the judge heard witnesses about the accident and heard an expert on the appropriateness of the claimed treatment costs.

According to the judgment, the driver and his insurance must also be liable for future consequences of injury.
