(ANSA) - ROME, JAN 28 - The Council, meeting today in the council chamber, examined the issues of legitimacy raised by the Supreme Court on the impossibility of recognizing in Italy, because in contrast with public order, a foreign judicial provision that attributes the of parents to two civilly united Italian men, who have made use of the surrogacy technique.
The matter was declared inadmissible.
But the Court, without prejudice to the prohibition sanctioned by surrogacy, has held that the current legal framework does not ensure full protection for the interests of the child born with this technique.
A solicitation was also advanced by the Court on the question of the recognition of the status of children for the natives by means of a medically assisted heterologous procreation technique, practiced abroad by two women, a question also declared inadmissible.
In the absence of a discipline applicable to the specific case, the Court has considered, at present, not to intervene and has addressed a strong warning to the legislator so that it urgently identifies the most suitable forms of protection of minors, also in the light of international sources.
