The Mendoza Justice ruled this Friday on the herd rape and the murder of
Paula Toledo (19)
, perpetrated in
2003
.
And he did so with a ruling that soon sparked controversy, because he sentenced
the only defendant
to
just 11 years in prison.
And it came after 17 years of claims.
That was the decision of the judges
Ariel Murcia, Alejandro Celeste and Esteban Vázquez
.
They resolved that this was the penalty that
Marcos Graín Osorio (36)
had to face
for having been a necessary participant in the crime of sexual abuse with carnal access aggravated by the
participation of 2 or more people
, but not femicide.
Graín Osorio was Toledo's boyfriend and he
was the one who gave her to her murderers
, who previously raped and tortured her, according to judicial investigators.
"I am not satisfied with the ruling. I told the president of the Court because it seems that it gives
more possibilities to criminals than to victims
, because serving a third of the sentence can get out. I am not satisfied at all, everything was done wrong , leaves much to be desired by the Judicial Power of San Rafael, "criticized
Nuri Ribota
, Paula's mother.
Marcos Graín Osorio.
Speaking to Radio Nacional, he renewed his questions about how the investigation was carried out and recalled that Graín Osorio escaped and was found in Misiones.
Social networks were once again the space to channel the indignation of those who demand Justice for Paula Toledo.
"Paula Toledo's family had to wait 17 years for the only defendant in the case to receive a sentence of only 11 years.
A ruling that is far from being an example of justice
. We will continue to ask #JusticiaParaPaulaToledo and for all," warned the National Senator for Mendoza, Anabel Fernández Sagasti, with a message that she posted on her Twitter account as soon as the sentence was known.

Prosecutor Pablo Peñasco had requested a 25-year prison sentence for the crime of sexual abuse followed by death as a necessary participant, while the plaintiffs had requested life imprisonment for "homicide criminis causa."
"I accept the things that the Toledo family has gone through in these 17 years, I imagine what they have felt, I know that with all this they have ruined their lives, but they have also ruined their lives
for my family and they continue to ruin our lives
"
Graín Osorio
said this morning
in the court that tried him.
"
That is why I ask for justice to be done
," he added in his last words before hearing the verdict.
"Poli", as the young woman was called, had an
informal relationship with Graín Osorio,
who went to look for her at her house to go for a walk in San Rafael the last night she was seen alive, on October 31, 2003.
According to the statements of witnesses,
both went to an abandoned house
, located at the intersection of Los Filtros and Jacarandá streets, where a group of young people from that same neighborhood and acquaintances of both used to meet regularly to drink and smoke.
According to the researchers reconstructed, there Paula Toledo was raped and killed.
The body of the young woman was found with signs of sexual abuse, cigarette burn marks and beaten in a field in the Sosneado neighborhood.
Due to the fact, they arrested Graín Osorio, the brothers
Víctor (16) and Alejandro Echegaray (17), Cristian Torres, Jorge Sánchez, Ivan Gauna (16) and Andrés Maravilla (27).
Graín Osorio assured that he arrived at the abandoned house with her, but that he left her with his friends and left the place.
There were three trials for the Toledo crime.
In the first instance, the defendants were released due to failures in the progress of the case and, later, they were detained again, although
only four of them reached the first trial
in May 2006 (the Echegaray brothers, Gauna and Rodríguez).
All were acquitted for the benefit of the doubt.
In the middle was when Graín Osorio ran away.
The security forces found him in Misiones and detained him to appear at the second trial that took place in August 2011.
Justice overpowered him for lack of evidence.
In 2016, the Court reviewed the ruling and ordered the third trial, which ended this Friday.
The lawyers for the victim's family had requested life imprisonment while the defenders requested the acquittal of Graín Osorio.
