Kristina Hänel takes the case of the controversial abortion clause to the Federal Constitutional Court in Karlsruhe.
"I filed a constitutional complaint against my conviction and the # 219a today," said the doctor on Twitter.
Hänel had become known nationwide because she had started a debate about the abortion clause in the penal code.
It was changed in March 2019.
The regulation prohibits, among other things, the public "offering" or "promoting" abortions "because of their financial advantage" or in a "grossly offensive manner".
In the reform, paragraph 219a received a new paragraph, according to which doctors can publicly inform that they are performing abortions.
For further information, however, you must refer to other places.
In December 2019, Hänel was sentenced to a fine of 2500 euros for violating the paragraph in an appeal process.
Last month the higher regional court (OLG) Frankfurt am Main rejected their appeal.
The doctor could not invoke the "exception from criminal liability" because her homepage also contained "detailed information about the" how "of abortion, according to the Higher Regional Court.
