Reconfinement: an "imperfect" travel certificate which raises questions

Complex, long and sometimes imprecise, the new version of the document for leaving home in confined areas is criticized.


In France, confinement goes hand in hand with the travel certificate.

For the third time in a year, part of the territory has been confined since Saturday and therefore experiences this constraint.

The inhabitants of Hauts-de-France, Ile-de-France, Eure, Seine-Maritime and Alpes-Maritimes must once again bring a certificate to travel.

Available from Friday night to Saturday, it is criticized for its complexity and imprecision.

The authorities have already warned that the controls of the police this weekend would be placed under the sign of "pedagogy", while the Ministry of the Interior agrees with the Parisian that the new certificate is "Imperfect" ...

Completing the new "derogatory travel certificate" means first of all immersing yourself in reading.

No less than 15 different exit patterns are possible.

Long, the whole fits on two pages instead of one in the old versions.

And this Saturday morning it is really two pages since the digital version is not yet available.

It should be later in the weekend, as well as on the TousAntiCovid application.

A (very) complex certificate

This certificate is not only long, it is above all complex.

It already has the particularity of grouping together exit authorizations valid both for the curfew, at the start, and for confinement, in a second part.

But, in addition, the introduction of reasons specific to confined areas requires familiarity with the legal language.

Here is what is written: "In the departments subject to reinforced measures, travel is only authorized within the department or within a perimeter defined by a radius of 30 km around the place of residence except for items indicated by an asterisk (*) ”.

The idea is to make it possible to travel over 10 km in certain cases.

The rule is to stay in your department.

But if it is too small or the inhabitants are on the edge of it, they have the right to walk within a radius of 10 km anyway, without leaving the confined areas.

It is also possible to go further, for example to make essential purchases within a radius of 30 km.

It is also possible to move beyond this 30 km zone because the move box is one of those with an asterisk.

A precision, again difficult to understand simply, is made.

To limit exchanges between confined areas and unconfined areas, people in unconfined areas must comply with two rules.

Do not enter these areas further than 30 km from their home.

2.

Respect the reasons marked with an asterisk or only be in transit to go beyond this limit.

The controls are unlikely to be obvious for the police as the cases are numerous.

Asked about BFMTV, Camille Chaize, spokesperson for the Ministry of the Interior, also admitted that the certificate is "complex".

Moreover, following in the footsteps of the government which wants to avoid pronouncing the word “containment” and as it is written on the certificate, it speaks of “more restrictive” or “reinforced” measures.

The pet problem

He remains authorized to take his pet out to relieve himself.

But the attestation presents an apparent contradiction.

This motif is number 8 and remains within the limit of “one kilometer around the home”.

In addition, in confined areas, it is authorized, according to reason n ° 12, to walk during the day "within a maximum radius of ten kilometers around the home".

Could the police reproach a master for taking his dog out, during the day, more than a kilometer from his home?

The concern could come from the fact that the reason n ° 8 is thought first for the curfew, not for the confinements.

In any case, that creates uncertainty.

However, the cases of legally questionable verbalizations have been numerous since the first confinement in spring 2020. Asked by Le Parisien about the legal uncertainty of the new certificate on pets, the Ministry of the Interior explains to us, in the conditional, that 'there shouldn't be a problem.

Before conceding: "this certificate is imperfect".
