Hans-Georg Neumann: Court orders release after 58 years

Hans-Georg Neumann has been in prison for longer than any other prisoner in Germany - for 58 years. Now the Karlsruhe Higher Regional Court has suspended his remaining custodial sentence.

As a young man, Hans-Georg Neumann shot a pair of lovers in January 1962.

On May 30, 1963, the Berlin Regional Court sentenced him to life imprisonment for road theft and double murder.

Today he is 84 and still behind bars.

Nobody in the history of the Federal Republic of Germany was a prisoner longer than Neumann.

Anyone who is sentenced to life imprisonment in Germany must serve at least 15 years.

Under certain conditions, the sentence can be suspended on probation after this period has elapsed - the decisive factors include the security interests of the general public, the personality of the perpetrator and his or her conduct in prison (Section 57 and 57a of the Criminal Code).

The Federal Constitutional Court ruled in 1977 that every prisoner must have the chance to regain his or her freedom.

Otherwise the prison system is not humane.

Neumann tried to seize this opportunity several times, but all applications for parole were rejected, most recently by the Karlsruhe Regional Court in May 2020. The psychiatric experts always give him negative prognoses.

But now Neumann's complaint before the Karlsruhe Higher Regional Court was successful: the court announced on Tuesday that by decision of March 17, 2021 it had ordered the 84-year-old to be released from prison after more than 58 years (

).

The first criminal division suspended the execution of the remaining custodial sentence on probation.

In addition, "the release of the convicted person at a certain future time as well as the immediate implementation and granting of measures to open the prison on the part of the prison had been ordered."
