Mps, Court: supervisory body omitted controls

This can be read in the reasons for the sentence with which last October the Court of Milan sentenced Alessandro Profumo and Fabrizio Viola to 6 years, accused as former president and former CEO of MPS.

This can be read in the reasons with which the Court of Milan last October sentenced Alessandro Profumo and Fabrizio Viola to 6 years, accused as former president and former CEO of MPS.

According to the judges, "the supervisory body - although equipped with penetrating powers of initiative and control (...) has substantially omitted the necessary checks". 


"We do not go into the merits of the reasons for the sentence, which are the subject of in-depth analysis by our lawyers, in view of the appeal to the Court of Appeal, in which we will ask for a radical revision of the sentence of first instance".

This is what the former president of MPS Alessandro Profumo and the former ad Fabrizio Viola affirm in a joint comment on the reasons for the sentence of first instance sentenced by the Court of Milan.

"In 2012, at the invitation of the Bank of Italy, we took on the role of president (Profumo) and managing director (Viola) of Mps. The macroeconomic scenario was extremely difficult, due to the Italian risk crisis, and the situation of the bank desperate. So it was a choice made for a spirit of service and certainly not for personal convenience. In particular, Profumo has renounced the remuneration for his position as president ".

This is what Alessandro Profumo and Fabrizio Viola affirm, commenting on the reasons for the sentence of the Milan court.

"In this context - they say - we have guaranteed the survival of Montepaschi".

"We would like to focus now on the notorious Alexandria and Santorini, whose damage caused to the bank we have brought to light, not others. As is well known, the 6-year sentence derives from our choice to adopt, for the two operations, the criterion of accounting "with open balances". This is in continuity with the previous accounting methods and in agreement with the supervisory and control authorities ".

"It is hardly necessary to remember - they add - that such a severe penalty actually puts us on the same level, that is, those who adopted an accounting criterion that is currently under discussion but not then, and those who destroyed what was the third Italian banking group , sentenced to just over 7 years ".
