The
national government
provided, through Joint Resolution 4/2021 published this Friday in the Official Gazette, that all those who have received
at least one dose
of any of the coronavirus vaccines
may be called to work in person
by their employers.
The text indicates that "employers may summon workers to return to work in person (...) who have received at least the first dose of any of the vaccines intended to generate acquired immunity against the COVID-19 authorized for use in the Argentine Republic,
regardless of age and risk condition
, after FOURTEEN (14) days after inoculation ".
Therefore, all people with comorbidities are included, although with some exceptions.
Also "health workers
with high risk of exposure
, exempted from the duty to assist at work", and beyond their age and risk condition may "be summoned after FOURTEEN (14) days of having completed the vaccination schedule in its entirety ".
The measure indicates that those who are called to return to their places of work "must present
reliable proof of the
corresponding
vaccination
or state, as an affidavit, the reasons why they could not access the vaccination."
On the other hand, those who "have the possibility of accessing vaccination and choose not to be vaccinated, must act
in good faith
and carry out everything in their power to alleviate the damages that their decision may cause to employers. ".
Companies must respect the protocols
Exceptions include people with: congenital immunodeficiencies, functional or anatomic asplenia (including sickle cell anemia), and severe malnutrition;
with HIV depending on the status (<350 CD4 or with detectable viral load);
with immunosuppressive medication or corticosteroids in high doses (greater than 2 mg / kg / day of methylprednisone or more than 20 mg / day or its equivalent for more than 14 days).
Neither are patients with oncohematologic disease up to six months after complete remission included in the measure;
with solid organ tumor under treatment, and transplants of solid organs or hematopoietic precursors.
The Resolution signed by Carla Vizzotti and Claudio Moroni, in their recitals, is based on "that with the results available at the moment, the vaccines used in Argentina demonstrated
adequate efficacy
for the prevention of serious forms and death from the disease, which reduces the risk and makes it possible for workers to return to their workplaces. "
And it is added: "by virtue of this, it is necessary to implement strategies that make it possible to
recover the work capacity of
the different sectors and establish the necessary conditions for the reinstatement of male and female workers to their workplaces.
In addition, it highlights "the importance of having developed and implemented
specific protocols
for each sector in order to prevent and take care of the health of workers, protocols that must be permanently reviewed and updated."
Each sector must study the way in which its workers will go to their jobs, since the latest restrictions implemented by the Government indicate that public transport can only be used by those who are considered essential, the educational community and those who have special authorizations.
On the other hand, from 0 to 6, transit is directly prohibited, except for essentials and those who travel for work reasons.
