Covid: final ok to the decree on the examination for lawyers

It introduces a special discipline for the qualification to the legal profession during an emergency (ANSA)


Final go-ahead of the Chamber of the Chamber to the decree law on the conduct of the exam for the qualification of lawyer during the Covid-19 emergency.

There were 383 votes in favor, four against, two abstentions.

The decree introduces a special discipline for the session of qualifying exams for the legal profession.

    In particular: - the written tests are replaced by a preselective oral test, preparatory to the canonical oral test;

- in the first oral test, the candidate, who must be present at the exam venue together with the secretary of the subcommittee (the other members of the commission are connected remotely), is asked to resolve a practical-applicative question in a subject between civil law or criminal law or administrative law, previously chosen.



    The candidate, after reading the question, must identify the problematic issues, the applicable substantive and procedural provisions, the relevant principles and any jurisprudential guidelines, being able to consult the annotated codes as well.


    To carry out the test, the candidate has one hour from the dictation of the question (half an hour for the preliminary exam, half an hour for the discussion);

- the second oral test, for which each candidate has between 45 and 60 minutes, covers 5 subjects, in addition to legal system and forensic ethics.



    The decree provides that in the event of positive COVID-19 or compatible symptoms, quarantine or fiduciary isolation, as well as in the case of proven health reasons, the candidate can request a new date for the test, by submitting an application to the president of the subcommittee. , properly documented.

The test must be carried out within 10 days from the end of the impediment.


    Finally, the number of examination sub-committees is increased, numerically reduced from 5 to 3 members.

For the first time, temporary university researchers (RTD-B) and military magistrates can be part of the examination committees.


    The dates of the tests will be communicated with a new decree of the Ministry of Justice, by 12 April 2021.
