After months of lockdown, Germans long for vacation.
But be careful: If you travel to a risk area, you may have to forego your salary in quarantine.
Summer, sun, beach and sea - this is what many Germans are longing for at the moment, who have a certain lockdown fatigue.
However, popular holiday destinations have now been declared a risk area *.
That means: After returning, vacationers have to be quarantined immediately, for several days.
Many have no idea that their salary * is at stake.
Quarantine: In this case, employees will continue to receive wages
Basically, it should be said: employees who have to go into officially ordered quarantine through no fault of their own (e.g. due to contact with Covid 19 patients or a positive corona test) continue to receive their salary.
The
sick pay, according to the Infection Protection Act (§ 56. 1, sentence 3 IfSG)
secured.
In practice, the employer pays continued wages and can have this reimbursed by the competent authority (Section 56 (5) IfSG).
Anyone who can work in quarantine
in the home office
receives their wages anyway.

The situation is different if an employee
knowingly travels to a risk area
and
then has to go into quarantine.
In this case, the quarantine is self-inflicted because, according to the respective state regulations of the federal states, there is an obligation to go into quarantine upon return.
Since the employee is unable to perform his work in accordance with Section 616 of the German Civil Code (BGB), he is
not entitled
to continued
remuneration
.
Also a compensation payment according to the Infection Protection Act
(Section 56 (1) sentence 3 IfSG) is out of the question in this case.
That was through the Third Civil Protection Act
regulated.
Since November 19, 2020, it has been explicitly stated that there is
no entitlement to compensation
if an
avoidable trip has taken place
in a risk area that was already classified at the time of departure.
In this case, avoidable means if “at the time of departure there were no compelling reasons for the trip that could not be postponed”, such as family emergencies (such as a funeral), urgent medical treatment or official appointments.
Those who cannot work from home then have to accept financial losses during the quarantine.

What happens if the holiday destination is suddenly declared a risk area?
If the holiday destination was only subsequently declared a risk area because the number of infections has risen rapidly, for example, employees have been lucky: Since holiday returnees have to go into quarantine through no fault of their own, the compensation payment according to the Infection Protection Act applies here again (Section 56 (1) sentence 3 IfSG ).
The continued payment of wages is therefore guaranteed!
When will I be on sick leave in quarantine?
By the way: Anyone who
shows
symptoms of Covid 19 disease
in quarantine
will be put on sick leave by the doctor.
As with any other illness, continued wages are paid through the employer.
