If the incidence rises above a certain limit, it usually applies automatically.

Federal emergency brake: What rules apply during the curfew?
In the event of a
curfew
, the apartment can usually only be left for a
valid reason
. During the
federal emergency brake
, a nationwide curfew
from 10 p.m. to 5 a.m.
applies in areas with a seven-day incidence of more than 100 new infections per 100,000 residents
. Exercise outdoors, such as walking and jogging, is allowed alone until midnight. However, the individual state governments can set stricter rules for the curfew. In Bavaria, for example, walks and jogging are prohibited after 10 p.m.
The term curfew is not clearly defined in Germany.
In the regulations of the federal states, a distinction is not always made between curfew and exit restrictions.
With the curfew, however, there are usually
stricter exceptions
to be allowed to leave the apartment than with an exit restriction.

Can I still drive to work if there is a curfew?
Although the home office is now part of everyday life for many employees, millions of people in Germany still have to go to work every day - even at night.
If you have to go to work during the curfew, you don't need to worry: the
way to work is a valid reason
to be able to leave the apartment.
Here, however, the respective wording of the state regulations (see below) must be observed.
In Bavaria, for example, “exercising professional or official activities or training purposes that cannot be postponed” is permitted during the curfew.
Do I need a certificate from my employer if the police are checking me?
In order to get to work in the event of a curfew, an
employer confirmation with a company stamp and signature
is not required, but is strongly recommended by labor lawyers in order to avoid trouble with the police. "In the case of police checks, such a certificate should be sufficient for the employee to make credible that he is on the way to or from work and thus has a
valid reason for leaving the apartment
