The ruling - issued unanimously - is novel because it is the first time that a prosecutor has been removed from office for this type of event. According to the file, the undue interaction of the prosecutor with a minor through Twitter and the criminal case in which Castro was sentenced to six and a half years in prison for rape and gender violence against his ex are added to the accusations. partner.

"The facts carried out by Castro, duly accredited in this trial,

are incompatible with his role as magistrate

And not only because they are intrinsically serious and notoriously important facts, as required by the Supreme Court for the removal to proceed. of the magistrate, but because it is also despicable that they were precisely committed by a magistrate who is a member of the body to which the National Constitution has expressly entrusted the defense of legality and to whom exemplary conduct is required ", argues the sentence. 


There is a striking fact: Castro was in 2007 the first coordinator of the Fiscal Unit for the Investigation of Crimes against Sexual Integrity, Trafficking in Persons and Child Prostitution.

The 58-year-old prosecutor has extensive experience in the matter of sexual crimes and has intervened in cases related to the subject, such as the one entitled "Jorge Néstor Mangeri on sexual abuse cut to death", from the record of the Oral Court in Lo Criminal N ° 9, in which the MPF obtained the conviction of the accused for the murder of Ángeles Rawson. But when the complaints against him for sexual and labor harassment became known in the media, Castro stepped aside and the allegations against Mangeri were brought forward by his peers Sandro Abraldes and Fernando Fiszer.

These antecedents were considered by the Court as an aggravating factor for Castro's situation.

The actions originated from a complaint of sexual and labor harassment and abuse of power made by employees who worked or had worked under their dependency.

It was then that the Trial Court, chaired by Adriana Donato, reached the conclusion of removing him from the position after numerous days of a trial in which more than 40 witnesses testified and thanks to the fact that the acting Attorney General,

, ordered the opening and asked the Court to suspend Castro. 

The ruling also had the endorsement of the other members of the Court, doctors Javier Panero, Héctor Recalde, Alejandra Obregón, César Grau, Laura Giosa and Juan Carlos Paulucci.
