(ANSA) - ROME, MAY 26 - "'The Public Prosecutor asks for filing when the elements acquired in the preliminary investigations are not such as to determine the sentence.' ".
This was stated in a note by Enrico Costa, deputy and head of Action in relation to the amendments to the delegated president under discussion in the Justice Commission of the Chamber.
"Our proposal - explains Costa - is clear: only investigations with solid foundations should be sent to the trial and not to 'deepen' shaky accusations: the Courts cannot be engulfed by files without elements, citizens cannot be drawn into exhausting and unfounded judgments. we count - Costa specifies - over 120,000 acquitted a year, for which the trial is a penalty in itself. Half of these, if the new evaluation rule were in force, would have obtained an archiving during the investigations. Now, because the norm to be effective, a further step is needed: the inclusion of prosecutors in the professionalism assessments of the outcome of the legal inquiries ", concludes Enrico Costa.
