The sentence of the first oral trial of Argentina for the dissemination of intimate sexual material, now classified in the Penal Code as "pornovenganza", was announced this Thursday in the province of La Rioja.
The Court of the Third Chamber for Criminal and Correctional Matters, chaired by Judge Edith Agüero together with magistrates María Petrillo and Fernando Romero, handed down the sentence in an event denounced in 2017, which served as the basis for including this figure as a computer crime in the Reform of the Penal Code.
Patricio Pioli, who was accused of "coercion and qualified minor injuries" against his ex-partner, Paula Sánchez Frega, and also for
leaking intimate photographs and videos
taken when he had a relationship with the woman, was sentenced to
five years in prison in the morning of this Thursday
.
Pioli, of San Juan origin and known in La Rioja as "El tatuador", for his work, was denounced by Sánchez Frega for
gender violence
and threats of dissemination of intimate material after ending their relationship in 2016.
Patricio Pioli's defense attorney denied the charges against his client and argued that it was a case of "
revenge porn
."
"You cannot go to trial for a crime that does not exist in the world of criminal offenses," he said.
"My client is accused of the
crime of coercion
, which implies an attack on people's freedom, since they argue that he had this girl threatened with disclosing intimate material of her if she interrupted the relationship, always according to the complaint," he explained to

He then added that "the so-called porn-revenge ('
sexting'
in judicial jargon) is not typified in the Penal Code."
It wasn't then.

Paula Sánchez Frega, a 28-year-old chef, was
the first woman to bring her ex to trial for spreading intimate videos of her
without her consent.
Sánchez Frega spoke with
Clarín
about the photographs and sexual filming that his ex-partner made: "With my consent, he recorded our intimate relationships (...) It did not bother me, I trusted him and I thought that he would not go beyond the circle of his friends ".
Patricio Pioli assures that his cell phone was stolen, some time before his ex-girlfriend's complaint.
But everything got out of hand, a situation that exploded in 2017 when the material reached social networks.
Moreno Castro had said: “The cause had a lot of public connotation in La Rioja, since my client is a well-known person, because of the job he performs.
But it should be noted that
the videos and photos show both the girl's and his intimacy
”.
In addition, he denied Pioli's responsibility: he assured that an "exhibition" was established in the Police ("Although the officers should have registered it as a complaint," he clarified) when
Pioli's cell phone was stolen
, time before his ex-girlfriend's complaint.
“Everything is in the file.
And we have accompanied with a series of testimonies that reinforce the theft of the telephone ”, he clarified.

Pioli was prosecuted for the crimes of "coercion" and "qualified minor injuries" with preventive detention, was detained for two weeks and was released thanks to the payment of bail.
