The regional court in Limburg, Hesse, has awarded a boy a compensation of one million euros for severe brain damage after a tragic chain of events during an antibiotic infusion in a hospital.
The court also sentenced the clinic and the specialist staff involved in the treatment to bear all future follow-up costs, as the court announced on Monday.
According to the court, the approximately one-year-old patient was so upset about the administration of the antibiotic via a vein that he choked on a piece of apple he had recently eaten.
The rescue measures taken by the clinic staff were flawed and even turned out to be "harmful".
The boy suffered serious brain damage due to a lack of oxygen and has been severely disabled ever since.
According to the court, the responsible nurse would have had to wait with the medication given the situation.
During the incident in December 2011, you had to expect that the small child could get upset and choke on the apple that you just ate.

In addition to the nurse, the judgment is also directed against an attending doctor and the hospital as a whole.
The boy was being treated for an infection at the time.
With its judgment, the court went well beyond the claim of the plaintiff, who had requested a minimum amount of 500,000 euros.
It justified its decision in particular with the dramatic health consequences for those affected.
The boy can hardly move or communicate because of his brain damage.
He has to be looked after and looked after around the clock, even eating and sleeping are associated with "anxiety states" for him due to health problems.
