(ANSA) - WARSAW, JUL 14 - The EU Court accepted the reasons of the European Commission, which asked for provisional suspension measures (pending a definitive judgment), regarding the competences of the disciplinary section of the Supreme Court.
Brussels turned to the EU Court in March because the disciplinary section, whose judges are indirectly appointed by the Warsaw Parliament, have taken arbitrary disciplinary measures against Polish judges deemed unwelcome by the government majority.
According to the EU Court, the arguments presented by the European Commission justify the granting of provisional measures. The Polish Constitutional Court replied by pushing the EU regulation that allows the European Court of Justice to rule on the "systems, principles and procedures" of the Polish courts, stating that this "is not in line with the Polish constitution".
In its appeal to the EU Court, the EU Commission warned of the violation of EU law, "since it allows the disciplinary section of the Supreme Court - whose independence is not guaranteed - to take decisions with a direct impact on judges and their way of exercising them. functions, seriously undermining the independence of the judiciary ", and consequently the legal order of the EU as a whole.
