The bill announced by the government last week to regulate the extension of the health pass passed before the Council of State on Monday.
The highest administrative court has expressed reservations on certain measures, in an opinion which remains advisory.
Mandatory isolation validated
It was one of the great novelties of this bill.
All people positive for Covid-19 must be isolated "for 10 days in the declared accommodation" and with "no exit, except between 10 a.m. and noon".
This is already the case for unvaccinated passengers arriving in France from a country classified as red by the State.
The question arose around the controls for this isolation: could a police officer knock on your house to check that you are respecting your quarantine?
The Council of State approved these controls… but only until 9 pm.
Health pass checks in bars, restaurants, etc.
Another complex question: how to sanction professionals who do not sufficiently control the health passes of their customers or their employees?
In the version of the bill approved by the Council of State, a fine of 1000 euros will be administered in the event of a first breach of control.
This sanction can go up to 45,000 euros fine and one year in prison.
The obligation to control the health pass in large shopping centers challenged by the Council of State
Several employees working in shopping centers warned of the technical impossibility of checking each customer at the entrance. They were heard by the Council of State, which considers that this measure is "likely to particularly concern the acquisition of essential goods, in particular food". Its members see it as “a disproportionate attack on freedoms”.
