Should an establishment check the identity of the person presenting a health pass? No, replies the Minister of the Interior, "except as regards the discotheques". If he wishes, notes Gérald Darmanin, however, the establishment can "request such proof to ensure that the holders of the pass are indeed the holders".

To ensure compliance with the health pass obligation, Gérald Darmanin gives instructions on checks in his circular. "The check carried out by the establishment was not properly carried out" if, during the check by the police, a customer is not able to present a valid health pass. "In this case, the operator must be fined as well as the customer", specifies the Minister. Any customer must also be able to prove his identity because during checks the police will ask for one, "to ensure that the bearer of the pass presented is indeed the holder". If this is not the case, specifies the circular, “the customer (…) must be fined”.
