Corona pandemic: Parents cannot legally enforce air filter systems

Parents from Lower Saxony wanted to use an urgent application to get the school authority to install room air filters in their children's schools. But nothing will come of it.

Parents from Lower Saxony wanted to use two urgent applications to ensure that their children's schools have to be equipped with room air filters.

So they have now failed at the Hanover Administrative Court.

The chamber rejected motions as inadmissible by decision of Thursday (Ref .: 6 B 4041/21).

The reason: The applications are not sufficiently determined.

It was not possible to see which specific rooms the children were using.

In addition, the parents should first have submitted an application to the competent authority.

In terms of content, too, the applications were unsuccessful, the Chamber found.

It is true that the required room air filters are useful with regard to the health protection of the students.

But the discretion of the authorities "has not yet narrowed in a way that would require an interim order by the administrative court," it says in the statement of reasons.

Parents can now lodge a complaint with the Higher Administrative Court

The aim of the urgent applications was that the respective school authorities equip the classrooms and teaching rooms of the schools visited by the children with room air filters.

The Lower Saxony State Parents' Council had previously made it clear that, from its point of view, infection protection in schools was not sufficient.

The state government, however, rejects the central purchase of mobile air filters for all school classes.

According to the information, the urgent requests should also ensure that the state instructs local public transport to reduce the number of seats in school buses and no longer offer standing room.

In the opinion of the court, this application is also not sufficiently specific: it is not clear which companies are meant, nor are days, times, routes and means of transport evident.

The parents can now file a complaint with the Lower Saxony Higher Administrative Court in Lüneburg.
