The »Palandt« will soon be the »Grüneberg«: The legal specialist publisher from Munich is changing the title of its most important collection of laws - because their authors played an active role during the Nazi era.


The legal specialist publisher CHBECK will rename several standard works from its publishing program, which so far still bear the names of lawyers who played an active role during the National Socialist dictatorship.

This includes the short commentary on the civil code »Palandt«, the collection of laws »Schönfelder« and the multi-volume basic law commentary »Maunz / Dürig«.

It is already certain, the publisher announced today in a press release that the next edition of the BGB short commentary, which will appear in November 2021, will bear the name of the judge at the Federal Court of Justice (BGH) Christian Grüneberg, who is currently the authors of the work coordinated. The loose-leaf commentary on the Basic Law will in future be called "Dürig / Herzog / Scholz". The Schönfelder collection of laws with laws on civil and criminal law will in future be published by Munich civil law professor Mathias Habersack, who is currently chairman of the permanent deputation of the German Lawyers' Association. In a loose-leaf comment on the Income Tax Act (EStG), which appears in the Vahlen publishing group, a CH-Beck subsidiary,the eponymous name »Blümel« will be replaced by that of the current editors Peter Brandis and Bernd Heuermann.

Renaming has been required for years

The renaming of "Palandt" in particular, but also other works, has been vehemently called for for years.

The publisher had previously pointed out the problem of the name in a foreword, but so far shied away from renaming the work.

The previous »Schönfelder« is probably the most important collection of laws for lawyers and is approved as a work tool in practically all legal exams, including the state exams;

"Palandt", as lawyers have called it up to now, may also be used in the 2nd state examination in Bavaria, for example.

The »Maunz / Dürig« is the most important major commentary on the Basic Law, which is regularly quoted by courts up to and including the Federal Constitutional Court.

“History cannot be undone. That is why we initially kept the historical names, ”explains publisher Hans Dieter Beck in the publisher's press release. “So the name Palandt was supposed to remain visible as a reminder of the darkest chapter in German legal history”, but it was not intended to be a memorial to him. "In order to rule out misunderstandings," says the publisher, the decision has now been made to rename this and other "works with namesake who played an active role in the Nazi era." As a reason why this is happening - only now - Beck said: "In times of increasing anti-Semitism, it is important to me to set an example through our measures."

The Bavarian Justice Minister Georg Eisenreich praised this as "a very significant decision".

This renaming is »necessary«, according to Eisenreich: »The namesake for collections of laws and commentaries must be personalities of integrity.

No National Socialists. "He has been exchanging ideas" with the publisher in a very trusting manner for months, "this spring Eisenreich also commissioned a study on Schönfelder and Palandt from the Institute for Contemporary History.

The Institute for Contemporary History is not due to start work until autumn.
