The Justice of Tucumán dictated
the
preventive detention
of a 23-year-old man accused of having
beaten a dog to death
.
The measure, valid for 15 days, seeks to protect the complaining party while the investigation continues.
The intervening judge, Carolina Ballesteros, granted the request of the Prosecutor's Office, considering that
the accused could escape or hinder the investigation.
"It is the first resolution of these characteristics and it
marks a before and after
that shows that we no longer want more victims of such aberrant acts. It was time to say enough and in this way a milestone has been marked within our jurisprudence ", highlighted the prosecutor Carlos Picón during the hearing.
"We are facing a historical precedent for Tucumán and possibly for Argentina on the issue of animal abuse, in this way a clear message has been given about how we should proceed as a society in the face of this type of violence that should not be tolerated," added prosecutor Marcelo Leguizamón.
The incident occurred on June 8 in the city of Lastenia, a town located 8 kilometers from San Miguel de Tucumán.
That day, a witness recorded the moment in which the accused attacked a dog in different ways.
The pet, called "Angel", was transferred to a veterinarian, but died in what, according to the judge,
"was a very painful agony
.
"
The case - the magistrate explained - began with a post on Facebook, where the people who had filmed the attack shared the images of the attacked dog.
The young accused was also charged with mistreating
three other dogs
that lived in his house and that were rescued by the authorities, for which
approach restrictions
had been imposed
.
However, the defendant and his family, Ballesteros explained to
TN
,
They failed to comply with these measures and tried to apply through Facebook, with a false profile, to
"re-adopt"
the animals.
Then, the Prosecutor for Complex Crimes filed charges for the crime of animal cruelty and requested the preventive detention of the accused.
When asked about the grounds of the measure by which she ordered that the defendant be imprisoned for 15 days, the judge explained: "It is based on the seriousness of the fact because it is a case of extreme gravity and extreme cruelty and because they had taken other measures that were not complied with ”.
In this sense, he expanded his concepts: “We granted it on the basis that there was a risk of continuing to obstruct the investigation, contacting the complainant.
The defendant's family
had tried to recover rescued animals
. "
The dead dog, which was in the street, was not the only one abused by the accused, but also had in his possession others who, according to the expert reports, had
“very marked injuries that caused terrible suffering”
.
