(ANSA) - ROME, AUGUST 06 - The theater director, as the artistic director of the staging, can be considered, the film director, co-author of the work: therefore they respect all the moral and patrimonial rights that belong to any author or co-author of a work of genius. This is the meaning of an order of the Court of Cassation (n. 17565 of 2021) which endorsed a decision of the Court of Appeal of Milan. The news was given by the lawyer Giorgio Assumma, president of the Legal Institute of Entertainment and Information, who spoke of a "historic decision.
After 80 years from the enactment of the special law on copyright, which took place in 1941, the requests formulated by all theater directors, led by LuchinoVisconti and Franco Zeffirelli, were accepted for the legal qualification of theatrical texts processors and authors of the relative staging ".
The story opened on June 20, 2015, with a theatrical mass at the Verona Arena of 'Aida', directed by Gianfranco de Bosio. In the days preceding the Corriere dellaSera had announced the performance by publishing a photograph of the stage, taken from above, explaining that the staging was the same one curated in the past by Zeffirelli. deBosio appealed to the Court of Milan to seek compensation for damages, but his request was rejected, consent of 12 December 2017. The Court of Appeal of Milan, on 20 March 2020, instead reformed the decision of the court claiming that the theater director can rise to the rank of author of the staging, when his work of interpretation of the literary text and the consequent direction of the various contributions take on a creative value.An orientation confirmed by the Supreme Court.
