A North Carolina American is suing the U.S. Transportation Security Authority (TSA) over an incident that occurred in May 2019 at the state's Raleigh-Durham International Airport.



She said her daughter, a 15-year-old transgender woman, was required to undress in order to undergo a physical examination by security guards.


The lawsuit filed by the mother, Kimberly Arway, states that her daughter was forced to undergo the procedure after the mirror machine at the airport alerted to a problem.

After a brief deliberation, one of the security guards informed Shayim that the daughter would be forced to go with him to a private room, where it would be necessary to strip her and search her body, including her intimate organs.



USA Today reports that the TSA website has an information page for transgender travelers.

This section states that while a passenger is undergoing a mirror, the security officer presses a button indicating the gender of the passenger (male or female), depending on how the passenger presented himself earlier.

The website also states that the scanned software is able to detect the anatomical differences between women and men.

In this way, if the pre-entered data does not match those actually discovered, further testing is warranted.

In violation of the United States Constitution

Arvey approached the court requesting that a jury hear the lawsuit, in which no amount of compensation was specified.

She further added that its purpose is also to prevent recurrence of such cases.

The indictment further states that employees of the U.S. Department of Transportation indicated to the girl that she would not be able to leave the place until the physical examination was performed.

According to the mother, this requirement is inconsistent with TSA policy as well as with one of the amendments to the United States Constitution.



The indictment further stated that a police officer was called to the scene, after the mother and her home refused to be examined, "which caused panic, anxiety, fear, an accelerated pulse and shortness of breath," the mother wrote.



Due to the two's refusal to be checked, they were forced to give up the flight, rent a car and drive a distance of about a thousand miles to the pavilion in Rochester, New York.



It was further reported that a spokesman for the U.S. Department of Transportation refused to comment on the lawsuit, as the matter is in legal proceedings.
