The city of Görlitz is allowed to remove the controversial installation "Kulisse" by the Dresden artist Lisa Maria Baier for a fee.
The Saxon Higher Administrative Court (OVG) in Bautzen rejected the artist's complaint against the decision of the Dresden Administrative Court on July 26th.
The work of art has been causing conflict in the Saxon border town for weeks.
With the installation not far from the Neisse, within sight of the Polish Zgorzelec, Baier had taken up the restrictive abortion law in neighboring Poland.
From the point of view of the city, this is in contradiction to the art object awarded in the “Görlitzer Art” competition.
"Kulisse" originally had Görlitz as the international filming location and now the topic of women's rights and abortion in Poland, it was said.
That is why the city wanted to dismantle the work of art earlier, which the artist took to court.
But it failed first before the Administrative Court in Dresden and now also before the Higher Administrative Court in Bautzen.
The OVG announced that Baier's application was "legally rejected".
The immediate termination of the contract in the context of the exhibition "Görlitzer Art" by the city is also effective, taking into account the freedom of art.
